Terms of Service

These terms are an agreement between you and Resonate Media LLC ("we", "us") about Milo (the "Service"), an AI accountability and fitness buddy you talk to by text message. By texting the Service or agreeing when it asks, you accept these terms and our Privacy Policy. If you don't agree, stop texting the Service.
1. It's an AI, and it's not medical advice
You are talking to an AI, not a person. Everything the Service says, including workout, running, nutrition, calorie, weight, sleep, recovery, and injury suggestions, is general information for motivation and education. It can be wrong, incomplete, or not right for you. It is not medical, nutritional, psychological, or professional advice and is not a substitute for a doctor, dietitian, or coach who knows you. Talk to a qualified professional before starting or changing exercise or diet, especially if you have a health condition, injury, eating disorder history, or are pregnant. Stop exercising and get medical help if you feel pain, dizziness, chest pain, or shortness of breath. The Service is not for emergencies. If you may be in danger or having a medical or mental health emergency, call 911 (or your local emergency number) or text/call 988 in the US. You're responsible for your own training, eating, and health decisions.
2. Who can use it
You must be at least 18 years old. You must only use a phone number or account that you're allowed to use.
3. Free trial, subscription, and cancellation
New users may get a 7-day free trial. After the trial, continued use costs $9.99 per month (plus any applicable tax), billed in advance through our payment processor, Stripe, and renewing monthly until you cancel. You can cancel anytime by texting the Service "manage my plan" and using the link it sends; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we don't give credits for partial months. We may change the price with at least 30 days' notice by text; the new price applies from your next billing period, and you can cancel before then. If a payment fails, access may be paused until it's resolved. When a trial ends without a subscription, the Service may stop responding.
4. Acceptable use
Don't use the Service to break the law; harass, threaten, or harm anyone; send anything you don't have the right to send; send sexual content involving minors; try to hack, overload, reverse engineer, or extract the underlying prompts or data of the Service; or use it to build a competing product. The Service has daily message limits. We may limit, suspend, or end access for abuse or to protect the Service or others.
5. Your content
You keep ownership of what you send. You give us permission to store and process it only as needed to run the Service for you, as described in the Privacy Policy. Don't send anything you don't want an AI service to process, such as passwords or financial account numbers.
6. Third-party services
The Service relies on others, including Apple iMessage (or a messaging provider), OpenAI, Stripe, Garmin, and Tailscale. Their terms and outages are outside our control. Connecting Garmin or Apple Health is optional, and you can disconnect anytime.
7. Changes and availability
The Service is provided on an "as is" and "as available" basis. It runs on personal hardware and third-party services and may be slow, interrupted, changed, or discontinued at any time. If we discontinue a paid Service, we'll stop future billing. We may update these terms; we'll text you about material changes, and continuing to use the Service after that means you accept them.
8. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee any fitness, weight, health, or performance result.
9. Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, illness, or loss arising from following or relying on the Service's suggestions. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 3 months before the claim or $10. Some places don't allow these limits, so they may not fully apply to you.
10. Indemnity
You agree to cover claims and costs (including reasonable attorneys' fees) arising from your misuse of the Service or breaking these terms.
11. Disputes
These terms are governed by the laws of the State of Iowa, USA, without regard to conflict of law rules. Before filing a claim, you agree to contact us and try to resolve it informally for 30 days. Any dispute that isn't resolved will be decided by binding individual arbitration under the American Arbitration Association's Consumer Rules, except that either side may bring an individual claim in small claims court. You and we waive any right to a jury trial or to take part in a class action. You can opt out of this arbitration section by texting or emailing us within 30 days of first using the Service. If any part of these terms is found unenforceable, the rest stays in effect.
